The recent Minnesota case of In re Emergency Guardianship of Albert Barnes illustrates an emerging class of cases where a dispute between a family proxy and a hospital over “medical futility” requires legal resolution. The case was further complicated by the patient’s spouse who fraudulently claimed to be the patient’s designated health care proxy and who misrepresented the patient’s previously expressed treatment preferences. Barnes demonstrates the degree of significant administrative and institutional support to the health care team, ethics consultants, and (...) futility committees that is required when a futility dispute escalates to the need for judicial resolution. An institutional futility policy, especially one that is endorsed by other regional medical centers and organizations, is an important foundation for a hospital that seeks judicial support in a dispute over medical futility in end of life care. This scholarly renditionof Jaspers' ´Introduction´ to his seminal work "The Great Philosophers" stays to theoriginal German text as true possible by upholding its idiomatic cultural expressions, complex sentence structure, and nuanced particularities provided that clarity of communication can be maintained. The substantive contents and the significance of this text, whose principal topic is greatness, are outlined here. The commitment to evidence-based practice in clinical psychology requires scientific investigation of the effects of treatment and mechanisms of change. Empirical evidence suggests that mindfulness-based treatments provide clinically meaningful improvement for people suffering from many important problems, including depression, anxiety, pain, and stress. However, the processes of change that produce these beneficial outcomes are not entirely clear. Central questions include whether mindfulness training leads to increases in the general tendency to respond mindfully to the experiences of daily life, and if (...) so, whether these changes are responsible for the improvements in mental health that are often observed. Answering these questions requires methods for assessing mindfulness. Several tools for this purpose are now available and early evidence suggests that they are useful and informative, despite shortcomings that require additional work. This paper summarizes the rationale for mindfulness questionnaires, the methods used to construct them, and research findings on their utility. Challenges related to maintaining consistency with Buddhist conceptions of mindfulness while applying psychological research methods to the study of its assessment are discussed. (shrink)

This article presents a sociological analysis of the changing role of women in the Catholic church over the past twenty years. The theoretical framework is drawn from The Social Construction of Reality by Peter Berger and Thomas Luckmann. Data are derived from the documents of Vatican II, the revised Code of Canon Law, research from 1965 to the present, and exploratory interviews with Catholic women recently appointed as church administrators. The aim of this contribution is to critically explore the understanding, the goals and the meaning of education in the philosophy of education by Jean-Jacques Rousseau. In his educational novel Emile: or On Education [Emile ou De l’éducation] (1762) he depicts his account of the natural education. Rousseau argues that all humans share one and the same development process which is independent of their social background. He regards education as an active process of perfection which is curiosity-driven and intrinsic to (...) each child. Rousseau’s educational goals are autarky, happiness and freedom. (shrink)

Sustained attention, a key cognitive skill that improves during childhood and adolescence, tends to be worse in some emotional and behavioural disorders. Sustained attention is typically studied in non-affective task contexts; here, we used a novel task to index performance in affective versus neutral contexts across adolescence (N = 465; ages 11–18). We asked whether: (i) performance would be worse in negative versus neutral task contexts; (ii) performance would improve with age; (iii) affective interference would be greater in younger adolescents; (...) (iv) adolescents at risk for depression and higher in anxiety would show overall worse performance; and (v) would show differential performance in negative contexts. Results indicated that participants performed more poorly in negative contexts and showed age-related performance improvements. Those at risk of depression performed more poorly than those at lower risk. However, there was no difference between groups as a result of affective context. For anxiety there was no difference in performance as a function of severity. However, those with higher anxiety showed less variance in their reaction times to negative stimuli than those with lower anxiety. One interpretation is that moderate levels of emotional arousal associated with anxiety make individuals less susceptible to the distracting effects of negative stimuli. (shrink)

In the ´Introduction´ to "The Great Philosophers" Karl Jaspers explores the criteria for recognizing human greatness in general and in philosphers in particular. He comments on the historical process related to the selection and grouping of great philosophers. Jaspers acknowledges the questionable aspect of greatness, yet he affirms that such distinction is indispensable. The 1957 English translation by Ralph Mannheim and Hannah Arendt of Jaspers' Die Grossen Philosophen and all its subsequent editions did not include this Introduction. By whatever general principles and mechanisms animal behavior is governed, human behavior control rides piggyback on top of the same or very similar mechanisms. We have reflexes. We can be conditioned. The movements that make up our smaller actions are mostly caught up in perception-action cycles following perceived Gibsonian affordances. Still, without doubt there are levels of behavior control that are peculiar to humans. Following Aristotle, tradition has it that what is added in humans is rationality ("rational soul"). Rationality, however, (...) can be and has been characterized in many different ways. I am going to speculate about two different kinds of cognitive capacities that we humans seem to have, each of which is at least akin to rationality as Aristotle described it. The first I believe we share with many other animals, the second perhaps with none. Since this session of the conference on rational animals has been designated a "brainstorming" session, I will take philosopher's license, presenting no more than the softest sort of intuitive evidence for these ideas. A list of groceries, Professor Anscombe once suggested, might be used as a shopping list, telling what to buy, or it might be used as an inventory list, telling what has been bought (Anscombe 1957). If used as a shopping list, the world is supposed to conform to the representation: if the list does not match what is in the grocery bag, it is what is in the bag that is at fault. But if used as an inventory list, the (...) representation is supposed to conform to the world: if the list does not match what is in the bag, it is the list that is at fault. The first kind of representation, where the world is supposed to conform to the list, can be called "directive"; it represents or directs what is to be done. The second, where the list is supposed to conform to the world, can be called "descriptive"; it represents or describes what is the case. I wish to propose that there exist representations that face both these ways at once. With apologies to Dr. Doolittle, I call them pushmi-pullyu representations or PPRs. (shrink)

: Following a long process of revision, a new version of the Declaration of Helsinki was approved by the World Medical Association in 2000. Two provisions of the Declaration address ongoing international controversies regarding research sponsored by industrialized countries and conducted in developing countries. Despite the issuance of the final version of the Declaration, opponents remain locked in debate. Moreover, the Declaration remained silent on other prominent controversies concerning international research. An analysis of these current controversies reveals reasons why they (...) are not likely to be readily resolved, despite apparent agreement by opponents on overarching ethical principles. (shrink)

This article identifies a prevalent strand of feminist writing on beauty and aesthetic surgery and explores some of the contradictions and inconsistencies inscribed within it. In particular, we concentrate on three central feminist claims: that living in a misogynist culture produces aesthetic surgery as an issue predominantly concerning women; that pain - both physical and psychic - is a central conceptual frame through which aesthetic surgery should be viewed; and that aesthetic surgery is inherently a normalizing technology. Engaging with these (...) ‘myths’, we explore the tensions uncovered through a historical analysis of the practices of aesthetic surgery as well as the challenges to feminist claims offered by post-feminism. In particular we seek to destabilize the connection in feminist writing between beauty and passivity. We argue that through aesthetic references to denigrated black and working-class bodies, young women may mobilize aesthetic surgeries to reinscribe active sexuality on the feminine body. (shrink)

A new political movement has arisen in bioethics, self‐consciously distingushed from the rest of the ield and characterized by a new way of writing and arguing. Unfortunately, that new method is mean‐spirited, mystical, and emotional. It claims insight into ultimate truth yet disavows reason.

On Reading Signs; Some Differences between Us and The Others If there are certain kinds of signs that an animal cannot learn to interpret, that might be for any of a number of reasons. It might be, first, because the animal cannot discriminate the signs from one another. For example, although human babies learn to discriminate human speech sounds according to the phonological structures of their native languages very easily, it may be that few if any other animals are capable (...) of fully grasping the phonological structures of human languages. If an animal cannot learn to interpret certain signs it might be, second, because the decoding is too difficult for it. It could be, for example, that some animals are incapable of decoding signs that exhibit syntactic embedding, or signs that are spread out over time as opposed to over space. Problems of these various kinds might be solved by using another sign system, say, gestures rather than noises, or visual icons laid out in spatial order, or by separating out embedded propositions and presenting each separately. But a more interesting reason that an animal might be incapable of understanding a sign would be that it lacked mental representations of the necessary kind. ABSTRACT The expansion of health research to low and middle income countries has increased the likelihood of exploitation and undue influence in economically vulnerable populations. In behavioral research, “reasonable availability”, which was originally developed for biomedical research and advocates for the equitable provision of any product developed during the research process, cannot always prevent exploitation. In such cases and settings, the informed consent process may lack cross-cultural validity and therapeutic misconceptions may arise. This article advocates for a mutual learning framework (...) where international researchers can gain cultural competence while training and empowering local partners, increasing community ownership of health research. We develop some parts of the theory of compact operators from the point of view of computable analysis. While computable compact operators on Hilbert spaces are easy to understand, it turns out that these operators on Banach spaces are harder to handle. Classically, the theory of compact operators on Banach spaces is developed with the help of the non-constructive tool of sequential compactness. We demonstrate that a substantial amount of this theory can be developed computably on Banach spaces with computable (...) Schauder bases that are well-behaved. The conditions imposed on the bases are such that they generalize the Hilbert space case. In particular, we prove that the space of compact operators on Banach spaces with monotone, computably shrinking, and computable bases is a computable Banach space itself and operations such as composition with bounded linear operators from left are computable. Moreover, we provide a computable version of the Theorem of Schauder on adjoints in this framework and we discuss a non-uniform result on composition with bounded linear operators from right. Les dynamiques de classe du changement agraire en Afrique ont fait l’objet de débats importants. Dans son ouvrage de référence, Femmes, greniers et capitaux, Meillassoux prédisait en 1975 la cannibalisation de la paysannerie, avec la domination croissante des relations capitalistes dans les campagnes. Pourtant, près d’un demi-siècle plus tard, la paysannerie reste une construction sociale, économique et politique pertinente. En s’appuyant sur le cas du Mozambique, cet article explore les significations contradictoires de la paysannerie dans le capitalisme contemporain. La première (...) section retrace la création du paysan-prolétaire en Afrique australe, en s’appuyant sur les travaux de Meillassoux sur la « communauté domestique ». La deuxième partie explore les différentes manières dont les camponeses improvisent leur subsistance à travers trois cas. Since its development, scientists have proclaimed that the novel gene editing technology CRISPR-Cas will allow them to modify organisms with unprecedented speed and accuracy. In agriculture, CRISPR-Cas is said to significantly extend the possibilities to genetically modify common livestock animals. Genetic targets in livestock include edits to optimize yield, minimize environmental impacts, and improve animal health, among other targets that could be environmentally, medically, and economically beneficial. In Germany, a transdisciplinary research consortium consisting of geneticists, local animal breeding organizations, social (...) scientists and legal scholars co-developed a “vanguard vision” (Hilgartner in Science and democracy: Making knowledge and making power in the biosciences and beyond, Routledge, London, 2015) for CRISPR-Cas edits in livestock that would improve animal health and benefit local small- to medium-scale farmers. Part of our social science work in this consortium was to discuss these specific application scenarios with members of the public in focus group settings. In this article, we trace how the public engaged with the consortium’s vision of gene editing in smaller-scale animal agriculture. We found that instead of engaging with the vision proposed, a majority of participants held an entrenched “sociotechnical imaginary” (Jasanoff and Kim in Minerva 47:119–146, 2009) that was rooted in “storylines” (Hajer in The politics of environmental discourse: Ecological modernization and the policy process, Clarendon, Oxford, 1995) focused on factory farming, drawing upon arguments from German public and media discourses, NGO campaigning, and political decision-making about genetically modified organisms in the early 2000s. Our analysis points to the difficulties of establishing alternative visions of technology use once a specific sociotechnical imaginary has been established in a distinct national context, and raises questions regarding the possibilities of responsible research and innovation for highly contested technologies. The Society of Professional Journalists' (SPJ) Code of Ethics divides the institutional duties of a journalist into four main categories, designed to capture the essence of what it means to be a good journalist: seek truth and report it, minimize harm, act independently, and be accountable. Clark Kent being Superman first and reporter second means his reporting suffers. He does pretty well with respect to the section of the code that concerns treating “sources, subjects and colleagues as human beings deserving (...) of respect. Clark Kent's dual life and the choices he makes as Superman keep him from meeting the minimum standards of journalistic ethics. Journalists are charged with revealing “unethical practices of journalists and the news media” and abiding “by the same high standards to which they hold others.”. (shrink)

Published in Vienna in 1936, _The Authoritarian State_ by Eric Voegelin has remained virtually unknown to the public until now. Sales of the German edition were halted following the Nazi invasion of Austria in 1938, and the entire printing was later destroyed by wartime bombing. In this volume, Voegelin offers a critical examination of the most prominent European theories of state and constitutional law of the period while providing a political and historical analysis of the Austrian situation. He discusses the (...) dismissal of Parliament in 1933, the civil war, the murder of Federal Chancellor Dollfuss, the adoption of the "Authoritarian Constitution" of 1934, and the predicament of being sandwiched between Hitler and Mussolini. A radical critique of Hans Kelsen's pure theory of law lies at the heart of this work, marking Voegelin's definitive departure from Neo-Kantian epistemology. For the first time, Voegelin elaborates on the important distinction between theoretical concepts and political symbols as a basis for explaining the nontheoretical and speculative character of ideologies, both left and right. He shows that _total_ and _authoritarian_ are symbols of ideological self-interpretation that have no theoretical value, a distinction basic to his later work in _The New Science of Politics._ Available for the first time in English, _The Authoritarian State_ is a valuable addition to the Voegelin canon and to the field of intellectual history in general. Nearly everyone agrees that sexual exploitation occurs and that, when it does, it is morally wrong. However, there is substantial disagreement over what constitutes sexual exploitation and why it is wrong. Is sex between freely consenting adults ever exploitative? Is prostitution always exploitative? What features of sexually exploitative interactions lead us to regard them as morally wrong? And if sexual exploitation is morally wrong, what should be done about it?These are not new questions for the social philosopher. However, recent criticisms (...) of social contract theory may lead us to wonder whether contractarianism has the resources to criticize important cases of sexual exploitation—particularly prostitution. Some liberals have defended prostitution “in principle,” arguing that when prostitution is truly consensual, there is nothing wrong with it. This is called “sound prostitution.” Indeed, in cases where the parties to a sexual exchange are both competent adults, liberals and libertarians have a difficult time criticizing it, since to do so runs the risk of imposing a local and historically specific sexual ideal on members of society who explicitly reject it or else suggests that the prostitutes and their clients are not really competent agents. Elements comprising a set of building blocks for a feminist reconstruction of citizenship might include: a critical synthesis of citizenship as a status and a practice; strengthening the inclusive side of citizenship (within and across nation-states); the principle of differentiated universalism, addressing tensions between an analysis grounded in difference and the universalism standing at the heart of citizenship; and a challenge to the binary thinking that constrains the articulation of women's claims to citizenship.
